FED:High Court to rule on Malaysia swap deal=2

The court on Tuesday finished hearing the arguments of refugee lawyers, who say the
so-called Malaysia solution - which would see 800 asylum seekers sent there from Australia
- is unlawful and should be struck down.

The lawyers argued Malaysia was an inappropriate destination to send asylum seekers,
because it had no legal obligations to protect them.

They also argued sending unaccompanied minors to Malaysia would contravene the government's
guardianship duties.

Chief Justice Robert French said the court would reserve its decision on the case until
August 31 at 2.15pm (AEST).

A Taliban insurgent commander .. suspected of being behind bomb attacks which wounded
four Australian soldiers last month .. has been captured.

MULLAH FAQIR was a key tactical commander for the insurgency as it tried to re-establish
itself in Oruzgan at the beginning of the traditional summer fighting season.

Australian Middle East commander Major General JOHN CANTWELL says his capture is a
significant blow to the Taliban's ability to plan and coordinate attacks against NATO-led
coalition forces.

MULLAH FAQIR and four others were caught on April 12 and he's been transferred to Afghan
security services to be tried.

MELBOURNE, Dec 7 AAP - Two elderly brothers on an evening joy flight have died in an
ultralight plane crash in northern Victoria.

Ted and Alan Berryman, both from NSW, were killed when their ultralight went down near
Yarrawonga after taking off on a planned two-and-a-half hour flight on Sunday evening.

Their bodies were found in the wreckage at Burramine, six kilometres from Yarrawonga,
about 8.45am (AEDT) on Monday.

Ted, 58, who lived and worked in Yarrawonga, was recently joined by his 60-year-old
brother who is believed to have gone there to help him build hangars at the local airfield.

Yarrawonga Airfield manager Peter McLean said he had told Ted flying conditions were
fine before the brothers took off around 6.30pm on Sunday.

"He flies around here, he was building hangars around here, he's been a good bloke
and he was a very competent pilot," Mr McLean told Network Ten.

Alan, from Lightning Ridge and Ted, from Manildra, were close, said Alan's partner
of 15 years, Carol Ramsey.

Ms Ramsey says she believes Alan was helping his brother with a building project.

"I'm not sure, to be perfectly honest, because when those two got together you never
knew what was going to happen," Ms Ramsey told AAP.

"They were pretty close."

Ms Ramsey said Alan did not fly planes.

"I'm pretty sure it was Ted's ultralight," she said.

Alan was a "jack-of-all trades", who did building and welding jobs around town.

"He was happiest when he was on a big machine, like excavators and things like that,"

Ms Ramsey said.

Lightning Ridge Bowling Club manager Ray Brown said Alan, known as Hooky, had lived
in the town for many years, was sociable and well-liked and would be sadly missed.

"I didn't know he'd left for Yarrawonga ... I think he was here last week, he comes
into the club just about every day for lunch."

Ken Pidcock, the chief flying instructor at the Orange Ultraflight Centre, near Manildra,
defended ultralight aircraft, saying they were very sophisticated machines.

They are administered by Recreation Aviation Australia which operates under the auspices
of the Civil Aviation Safety Authority (CASA).

Mr Pidcock said ultralights can be bought in kit form but they are inspected by authorities
in the course of construction.

"It is the fastest growing sector of aviation and training is almost identical to general
aviation," Mr Pidcock told AAP.

"They are not unlike a Cessna 150 and are equipped with modern implementation."

Police are investigating the crash.

MELBOURNE, April 29 AAP - A motorcyclist ran into an elderly pedestrian and then tried
to kick her away from his bike as she clung to it while he was attempting to flee, a court
has been told.

Joan Stafford, 69, was critically injured when the bike hit her as she crossed Plenty
Road in Preston, in Melbourne's north, about noon on Easter Sunday.

Mark Maccar, 24, of Mill Park, was on his way back from church when witnesses saw him
hit Ms Stafford, the Melbourne Magistrates Court has been told.

Senior Constable James Mitchell said witnesses saw Maccar strike an object and repeatedly
kick at it with his left foot.

They later realised the object was an elderly woman who was caught across the front
of the bike where she had hung on for five to 10 metres, he said.

Sen Const Mitchell said the woman landed head-first on the road and suffered head injuries
and a broken leg.

He said Maccar fled on his bike.

Before the incident, witnesses had reported Maccar was doing "wheelies" and travelling
up to 85km/h in a 60km/h speed zone, he said.

Maccar later allegedly confided to his motorcyclist friend riding alongside him that
he had hit someone and said he should not tell anyone.

Sen Const Mitchell said Maccar's thoughts were only of his escape and he had taken
steps to alter his bike and hide parts that had broken off it.

Maccar is charged with failing to stop at an accident and failing to render assistance,
negligently causing serious injury and dangerous driving causing serious injury.

Police are opposing his bail application, saying he poses an unacceptable risk of offending
and interfering with witnesses.

Ms Stafford remains in a semi-conscious state in the Royal Melbourne Hospital.

The bail application continues.

NSW: Sydney to Hobart yacht crew rescued by police.

SYDNEY, Dec 27 AAP - The crew from a damaged yacht in this year's Sydney to Hobart
yacht race are back on dry land after being rescued on the south coast.

The 16m yacht, Georgia, issued a mayday call just before 10pm (AEDT) on Friday.

It was located about 45 nautical miles east of Ulladulla by other race yachts after
losing its rudder.

There were no reported injuries and the 14-member crew were taken by police to Bateman's
Bay for medical treatment.

The brother of a 22-year-old man .. killed in an avalanche in the Kosciuszko National
Park .. tried to warn him he was in danger just moments before he was swept to his death
by a wall of ice and snow.

TOM CARR-BOYD was crushed to death after a collapsed segment of hardened snow .. known
as an ice cornice .. gave way and caused an avalanche about 5km from Charlotte Pass.

Inspector PETER ROONEY says Mr CARR-BOYD's brother .. who was below the cornice ..

noticed it was unsafe and yelled out to the 22 year-old.

He says when Mr CARR-BOYD tried to move off the top of the cornice it collapsed underneath him.

Insp ROONEY says the young man tried to ski on top of the moving wall of snow but was overtaken.

An Aboriginal community in Western Australia's far north has been given a new swimming
pool as part of a deal with the federal government .. designed to entice children to attend
school.

The community pool was opened yesterday in the Kimberley community of Warnum .. to
mark the beginning of a shared responsibility agreement with the Western Australia and
federal governments.

Under the agreement .. children have to go to school for access to the pool to continue.

The use of swimming pools has also had a health impact .. with the opening of other
community swimming pools resulting in a decreases in skin infections and ear diseases.

CANBERRA, Dec 7 AAP - The commonwealth intervention into Northern Territory Aboriginal
communities will fail unless the new government takes steps to improve indigenous people's
participation in it, a new human rights report says.

In the Human Rights and Equal Opportunities Commission (HREOC) annual report, President
John von Doussa says measures in the intervention that bypass racial discrimination laws
have put Australia's proud human rights reputation at risk.

Mr von Doussa says it is now "critical" there be comprehensive consultation with communities
targeted by the takeover.

"Steps must be taken to ensure that they understand the new measures and have realistic
opportunities to participate in the implementation of programs that are intended to improve
their wellbeing," Mr von Doussa said.

"Unless there is culturally appropriate and meaningful consultation and respect given
to the wishes of the communities affected, HREOC is concerned that the laudable object
of the legislation will not be achieved."

Aboriginal and Torres Strait Islander Social Justice Commissioner Tom Calma said he
had spent a lot of time in the past year trying to convince people Aboriginal disadvantage
could be overcome.

"My 25-year vision is that of an optimist," Mr Calma said in his section of the report.

"My vision is for a country where the current state of indigenous disadvantage will
be as incomprehensible to future Australians as the White Australia policy is to the present
generation."

Vic: Nursing home CEO hits back at minister

The management of a Melbourne nursing home where five elderly residents died after
an outbreak of illness over Easter .. have attacked the federal Minister for Ageing ..

CHRISTOPHER PYNE.

Mr PYNE says the deaths at Broughton Hall from suspected gastroenteritis could be linked
to 12 areas where the home had breached health and safety standards .. identified in a
report he released yesterday.

Twenty-one residents have fallen ill with gastroenteritis-like symptoms at the nursing
home .. managed by Anglican Church agency Benetas .. and eight of those have been diagnosed
with salmonella poisoning.

Benetas chief executive SHARON CALLISTER yesterday afternoon said there's no evidence
to date the residents died of gastroenteritis or salmonella .. or that the deaths are
related to any lack of care at Broughton Hall .. and it's up to the coroner .. not the
minister to determine the cause of death.

The nursing home has seven days to make a written submission in response to the report.

CANBERRA, Dec 23 AAP - An Australian man is in custody in Lebanon in relation to a
child custody dispute, the Department of Foreign Affairs and Trade (DFAT) has confirmed.

Former Australian soldier Brian Corrigan, 38, and David Pemberton of New Zealand, were
hauled from a plane at Beirut's international airport on Wednesday afternoon, according
to media reports today.

The pair could face up to 15 years in jail on charges of kidnapping minors over their
alleged involvement in a so called mercenary squad hired by Canadian woman Melissa Hawach
to retrieve her daughters who had been taken by their Lebanese-Australian father.

DFAT today said foreign affairs officials had offered assistance to Mr Corrigan and
his family following his arrest.

"We are aware of the detention of a 38-year-old Australian man in Beirut on December
21," a spokeswoman said.

"We understand he is being held in relation to a child custody matter.

"The Australian embassy in Beirut is providing consular assistance and liaising with
local authorities.

"Consular officials are also in contact with the man's family in Australia."

DFAT had no information on the whereabouts of another former Australian soldier, James
Arak, reported to have fled Lebanon after the alleged kidnapping along with two New Zealand
mercenaries.

The department was still seeking further updates on the situation, the spokeswoman said.

CANBERRA, Aug 16 AAP - The Howard government believes it will damage the economy, and
two Labor premiers are no more than lukewarm towards a states' plan for a carbon trading
scheme.

NSW Premier Morris Iemma, South Australian Premier Mike Rann and Victorian Environment
Minister John Thwaites today released a discussion paper on the plan, predicting only
modest increases in electricity prices for a reduction in greenhouse gases.

Under the plan, greenhouse gas emissions from Australia's electricity industry would
be capped at between 1997 and 2000 levels by 2035.

Electricity generators would be required to hold permits to emit greenhouse gases but
would be able to purchase extra permits and offset emissions through forestry and capturing
or storing carbon.

Federal Environment Minister Ian Campbell today sought to divide Labor states, saying
the scheme was, in effect, a new tax imposed on Queenslanders and West Australians by
NSW and Victoria.

"This is so bad for Queensland, so bad for WA," he said.

"This is a scheme that was dreamed up in Sydney with strong support from the left in Victoria."

WA Premier Alan Carpenter said his state would not commit to any form of national greenhouse
gas emissions trading without assurances that there would be no adverse effects.

He said the discussion paper had raised concerns about the impact on the state's economy
and on consumers' electricity costs.

"I would also want assurances that any trading scheme would not adversely impact the
state's capacity to rely on energy sources such as coal," Mr Carpenter said.

Mr Carpenter also said the federal government's lack of engagement in the plan would
severely weaken its prospects of success.

Queensland Premier Peter Beattie was also guarded about the plan.

"I believe in carbon trading but I also believe that we need to examine technology
like clean coal technology," he told reporters.

"We want to play our role in not just reducing emissions but selling our technology to China.

"I refuse to support things that sound good but deliver bugger all."

Mr Iemma said possible electricity price increases under the scheme had been exaggerated.

He said if the scheme began in 2010, the price of electricity for households would
probably go up by 59 cents per week and about $1 by 2033.

"They are modest increases," Mr Iemma said.

"The cost to everyone of not taking action on climate change and reducing greenhouse
gases is immense."

But Prime Minister John Howard said the carbon trading scheme would damage the economy.

"Until we have a protocol throughout the world that includes all of the major emitters,
and that means the inclusion of countries such as China, the US and India ... the idea
of one country unilaterally embracing and emissions trading scheme will result in great
damage to that country," he told parliament.

"If we were to sign the Kyoto Protocol (which includes a carbon trading scheme), we
would accept burdens that would not apply to our competitors such as China and Indonesia."

Australian Greens senator Christine Milne predicted the government would eventually
be forced to join a national carbon trading scheme.

"Progressive industries are asking for it," she said.

"Certainly in the US it's clear, and all the renewable energies are saying, that they
cannot get the investment they need without a price signal on carbon."

Labor's environment spokesman Anthony Albanese attacked the government for failing
to back a national scheme.

"Climate change is the most important issue facing the global community and a national
emissions trading scheme is the least cost way of reducing emissions," he said.

The Australian Conservation Foundation said economic modelling for the scheme estimated
it would add between $1 and $3.20 to weekly household electricity bills.

CANBERRA, April 3 AAP - Indonesian President Susilo Bambang Yudhoyono has arrived in
Canberra for a three-day visit to Australia.

President Yudhoyono's visit, delayed for four days by the devastating Sumatran earthquake,
is only the third by an Indonesian leader in the past 30 years.

He was greeted at Canberra airport by Governor-General Michael Jeffery and Prime Minister
John Howard along with a military honour guard.

About 100 protesters lined the road from the airport but Mr Yudhoyono avoided seeing
them as he was whisked away in a car across the tarmac to another road, escaping the protesters
altogether.

Mr Yudhoyono will attend a state dinner at Government House later tonight where he
will be joined by Major General Jeffery, his wife Marlena, Deputy Prime Minister John
Anderson, Foreign Minister Alexander Downer, Opposition Leader Kim Beazley and Defence
force chief Peter Cosgrove.

Driving examiner strike - candidates to attend tests.

The Driving Standards Agency is urging all driving test candidates booked to take a test on Thursday 30 June to attend as usual regardless of the threat of strike action by examiners who are members of the Public and Commercial Services (PCS) union.

Driving Standards Agency's chief executive Rosemary Thew said:

"Not all examiners are members of the PCS union and even if they are, we cannot be sure that they will not turn up for work. We therefore want candidates to attend so that practical tests can be delivered if possible. Theory tests are not affected and will be taking place as planned.

"Candidates who turn up but are unable to take their tests because of industrial action will not have to contact DSA to re-book. They should hear from us with a new date within five to ten working days. We apologise for the inconvenience this will cause and will do everything we can to minimise disruption for our customers."

If no examiner is available for a test, a new date will be rebooked automatically by DSA and the candidate will be sent details of the new test. If candidates fail to attend they will not be able to claim out-of-pocket expenses if their tests are cancelled and they will need to rebook their own tests.

DSA's customer service centre for practical tests might also be affected by the strike action. Customers who wish to book a practical test will still be able to use our internet booking service at www.direct.gov.uk/drivingtest .

US ANNOUNCES NEW AFRICAN TRADE CAPACITY BUILDING INITIATIVE AT AGOA FORUM.

WASHINGTON -- The following information was released by the U.S. Agency for International Development:

The United States announced an additional commitment of up to $30 million per year for four years, subject to availability of funds, to boost trade capacity in Africa. United States Trade Representative, Ron Kirk, made the announcement during the opening session of the Tenth African Growth and Opportunity Act (AGOA) Forum today in Lusaka, Zambia.

This support will be directed to African Trade Hubs through the African Competitiveness and Trade Expansion Initiative (ACTE). The trade hubs -- located in Accra, Ghana (with a satellite office in Dakar, Senegal); Nairobi, Kenya; and Gaborone, Botswana -- are regional leaders in trade-related technical assistance that promote increased trade between Africa and the United States, among other African countries, and with the world. Enacted in 2000, AGOA aims to boost economic growth in Africa and, by extension, increase regional stability, and reduce poverty by providing duty-free entry to the U.S. market for most goods produced in eligible sub-Saharan African countries.

The ACTE initiative reflects the continuing commitment of the U.S. Government to support African trade capacity building and to help Africans to use trade to advance economic growth and development. ACTE also compliments activities taking place under Feed the Future, the U.S. Government's global hunger and food security initiative.

By building on the success of previous trade promotion activities in the region, this investment will facilitate an increase in African exports of non-traditional, value-added products, such as those promoted under AGOA, including apparel, footwear, and processed agricultural products. It will also help to enhance Africa's trade image in world markets, tailor trade-boosting activities to specific countries and sectors, and support evaluation and promotion of the most effective methods for building sustainable trade capacity. In addition, activities funded through this commitment will leverage private sector resources and investments by other donors.

Through ACTE, USAID will broaden and deepen the African Trade Hubs' ability to facilitate agricultural trade and develop successful value chains, as well as assist African firms in meeting plant health and food safety standards for their exports. ACTE will also help to improve the business-enabling environment for trade by reducing trade costs within Africa and working with businesses, trade associations, and governments to develop national export promotion and diversification strategies.

Previously, USAID channeled its work in this area through the African Global Competitiveness Initiative (AGCI), a five-year program launched in 2006. Through 2010, AGCI trade and investment programs facilitated over $178 million in AGOA exports, provided export capacity building assistance to over 234,000 firms, and trained nearly 660,000 Africans in trade capacity building. TOKIO, Japan -- The following information was released by the office of the Prime Minister of Japan:

CABINET PUBLIC RELATIONS SECRETARY: We will now begin the press conference by Prime Minister Naoto Kan. Prime Minister, your opening statement please.

Opening Statement by Prime Minister Naoto Kan

PRIME MINISTER KAN: Tomorrow marks two months since the Great East Japan Earthquake. I have heard that as many as 80,000 people participated in volunteer activities in the areas affected by the disaster over the 10-day Golden Week holiday period. I would like to express my heartfelt respect to each and every one of these volunteers.

Over the holiday period, I myself visited shelter for the residents of Futaba Town in Fukushima Prefecture, who have evacuated from their homes due to the nuclear incident. During this visit, many people told me that they want to go back to their old lives. I also heard many harsh criticisms of the response made by the Government. This experience inspired me with a renewed desire to work even harder to help these people return to their former lives as quickly as possible, if even only one day sooner.

During Golden Week I also visited a store in Yaesu here in Tokyo that sells the products of Fukushima Prefecture. I purchased sake, rice, vegetables, and miso paste.

Shortly after my visit to that store, I was able to have a conversation with a group of people who are using the internet to sell vegetables and other goods produced in the disaster-affected region. The internet provides an excellent method of support for those who want to help but cannot go to the area as volunteers or those who have sent relief goods, want to do more, and donft know what they can do, in that through the internet people can purchase the products of the affected areas. It is a method that allows anyone, no matter where they live, to cooperate with recovery efforts, and, as I learned during the meeting, it is a method that many people are currently making use of.

And people are not just making purchases over the internet - they are also communicating with those living in the disaster-affected region. I learned during the meeting about how the internet is facilitating ever-greater connections between individuals. I expect that more and more people will participate in activities like this, and that these activities will continue to widen the disaster-affected regionfs network of support.

Turning to other matters, on May 2 we established the first supplementary budget, having received the unanimous approval of the Diet members of each party. Although we must continue to further strengthen our recovery efforts, at the same time we must now begin to take the first steps toward reconstruction. We shall first pass the Basic Act on Reconstruction, and then in order to create a system to implement this Act, we shall amend the Cabinet Law. It is my hope that we will be able to decide on our policies for these two pieces of legislation within the Cabinet and submit bills to the Diet before the weekfs end. I want to put the full force of the Government behind the establishment of these bills, and I want to do so while listening to each opinion offered by opposition parties.

Moving on, I am extremely pleased and grateful to be able to say that Chubu Electric Power Company has quickly accepted my request regarding the suspension of operations at Hamaoka Nuclear Power Station. However, this move has given many causes for concern over possible power supply shortages. This is something that I have been discussing with Minister for Economy, Trade and Industry Banri Kaieda since before I issued my request. I believe that with the cooperation of other power companies as well as businesses and individuals, we can avoid power shortages moving forward. I ask tonight that everyone provide us with such cooperation.

As I stated in my last press conference, the reason behind my decision to request the suspension of operations at the Station was a consideration for the safety and well-being of the people. I also considered the extremely large effect that a disaster in Hamaoka would have on the economy of Japan if the worst case scenario should come to pass. Although the suspension of Station operations will mean a lot of hard work for those it directly affects, I believe that this is necessary in order to protect the safety and well-being of the public.

While I am on the topic of the recent nuclear incident, we are now proceeding with preparations for the inauguration of a Nuclear Incident Investigation Commission. The formation of this Commission will be based on three basic ideas.

First, the Commission should be independent of all currently existing nuclear authorities. In other words, it will be a body formed around those with no previous affiliation to such organizations; those who can make independent judgements.

Second, the Commission should be open to the public and the international community. Its discussions should be truly transparent.

Third, we believe that the discussions of this Commission must be comprehensive, which is to say that the Commission should not just discuss technical issues - it should consider the systems and past organizational structures we had in place and how they affected the incident this time. We need a comprehensive consideration of issues like these as well.

Independence, transparency, and comprehensiveness: these are the three principles around which we are preparing the formulation of the Nuclear Incident Investigation Commission.

At the same time as we work to establish this organization, we are also moving forward with the creation of a scheme by which to pay out compensation for the nuclear incident. As I have said time and time again, Tokyo Electric Power Company (TEPCO) should bear the primary responsibility for the payment of such compensation. However, I want the Government to also actively shoulder a portion of this responsibility in order to ensure that each affected person receives an appropriate amount of money.

In light of the current issues we face, there has recently been a lot of debate about what Japanfs energy policy should look like in the future. In terms of nuclear power, first and foremost, it is vital that we ensure public safety. Up until now, nuclear power and fossil fuels have been the two pillars of our energy supply. However, in consideration of both the recent nuclear incident and the issue of global warming, I believe that two other pillars are now also vital for us. The first of these is renewable and natural energy sources such as solar, wind and biomass power. We will add these to our core energy sources. This is my first proposal.

The second pillar I want to propose is energy conservation. We must ask ourselves if it is acceptable for us to continue consuming so much energy. I propose that we must work to create a nation which conserves energy through innovative activities or by making different choices regarding how we structure our society. I believe that energy conservation should become yet another pillar of Japanfs energy policy.

As we move forward, we must exert even greater efforts than we have in the past on this issue. We must work to ensure the safety of our nuclear power stations. We must reduce the amount of CO2 emissions caused by the use of fossil fuels. And as we do this, we must establish natural energies and energy conservation as two new pillars of our national energy policy. I hope to move forward with debate on the overall reviews of our policy with these concepts in mind.

Before I conclude, I want to say that while the direct cause of the nuclear incident this time was the earthquake and subsequent tsunami, the major responsibility for having been unable to prevent this incident lies with the operator of the power station, TEPCO, and those of us in the Government who have enforced Japanfs nuclear policy up until now. I want to express my sincere apologies to the nation for having been unable to prevent this incident. I am truly sorry.

I understand the responsibility I bear for this, and with this in mind, I shall be returning my annual salary as Prime Minister to the nation until the incident at the nuclear power station has been brought under control. I plan to begin doing this from June.

This concludes my report today on the issue of nuclear power and the way forward for recovery and reconstruction efforts.

CABINET PUBLIC RELATIONS SECRETARY: We will now move on to the QandA session. Although I will be calling on you to ask questions, we would appreciate it if you would still state your name and affiliation. Thank you. Yamaguchi-san, please.

REPORTER: I am Yamaguchi of NHK. In the two months since the disaster, the first supplementary budget has been approved and you are now speaking of commencing full-fledged recovery efforts. Meanwhile, at a recent meeting between the heads of the Liberal Democratic Party (LDP) and the New Komeito Party today, it was said that the second supplementary budget should be submitted to the Diet soon. Do you plan on submitting the second supplementary budget during the current Diet session, which is nearing its close, or do you intend to end the current Diet session and then call for deliberations on the second supplementary budget by opening an extraordinary session?

PRIME MINISTER KAN: The first supplementary budget is quite large - more than four trillion yen - and should therefore be enough to cover a significant portion of the financial resources needed for recovery efforts. The Reconstruction Design Council is currently discussing how to proceed with reconstruction moving forward. We will consider such issues as how much financing will be necessary to implement their proposals when the time comes to do so.

In that respect, our first step will be to actively push forward the recover work currently underway. We have yet to decide on an appropriate time to submit the second supplementary budget, which will help to facilitate reconstruction.

CABINET PUBLIC RELATIONS SECRETARY: Yes, next please, Arimoto-san.

REPORTER: I am Arimoto of the Nishinippon Shimbun. I would like to ask about the Governmentfs policy on nuclear power stations. You stated that Hamaoka Nuclear Power Station, which you had requested for shutdown, is a special case. On the other hand, the probability of an earthquake occurring in Fukushima was extremely low, yet it happened nonetheless and we now face the consequences. There are many nuclear power stations that neighbor fault zones and the public is still very concerned over the safety of each of these facilities. How do you plan to gain local understanding as you undergo the process of revising Japanfs overall nuclear power policy, including safety standards? Are you planning on requesting that operations at other stations as well be suspended or that their recommencement be postponed?

Also, concerning the incorporation of natural energy sources as one pillar of national energy policy, which you mentioned earlier, is it correct to understand your statement to mean that the Government plans to decrease Japanfs reliance on nuclear power in the future?

PRIME MINISTER KAN: Allow me to first respond to your question concerning other nuclear power stations - as I have said in the past, the reason that I requested the suspension of operations at Hamaoka Nuclear Power Station is because an evaluation by the Headquarters for Earthquake Research Promotion of the Ministry of Education, Culture, Sports, Science and Technology (MEXT) indicated that there is an extremely high possibility - an 87% chance to be exact - of a major earthquake of around magnitude 8 occurring within the next 30 years. That is why I requested that operations be suspended. There are of course various different possibilities regarding other nuclear power stations as well, but at the very least, forecasts provided by earthquake research centers have not reported a situation as urgent as the one surrounding Hamaoka Nuclear Power Station. That is why I requested the suspension of operations at that station.

Concerning your other question on energy - or on what the position of nuclear power is - the current Basic Energy Plan stipulates that Japan aims to have nuclear power account for more than 50%, and reusable energy account for 20%, of the power we consume by 2030. However, due to the major incident that occurred in Fukushima, we must dismiss the current Basic Energy Plan and start discussions over from a clean slate.

In the process of doing so, we will work to ensure an enhanced level of safety for nuclear power, while at the same time more vigorously promoting natural and reusable energy. I believe that this is the direction we must follow, and I intend to advance discussions with these points in mind.

CABINET PUBLIC RELATIONS SECRETARY: Could we have Tanaka-san next, please?

REPORTER: I am Tanaka of the Mainichi Shimbun. I have a question about TEPCOfs cost-reduction measures. Today, TEPCO made a proposal for certain restructuring measures to Chief Cabinet Secretary Edano and Minister Kaieda, including a complete reduction of remuneration for executive officers with voting authority. Do you feel that their offer is adequate? Do you think the company should do more?

Secondly, you mentioned earlier that you will be returning the annual salary you receive as Prime Minister. Does this mean that you will continue to receive a salary equivalent to that of a member of the Diet? Could you provide clarification on that point please?

Finally, will you also be calling on other Cabinet ministers to give up their annual salaries as well?

PRIME MINISTER KAN: First, I have heard that TEPCO is exerting the greatest efforts possible to provide compensation for those that have been affected by the incident. These efforts include the liquidation of various assets, a further reduction in headcount to streamline the company as much as possible, and the salary reductions that you just mentioned. I am aware of their efforts, and I accept that the proposals that TEPCO offered today are one part of such efforts. As to whether these efforts are sufficient, we will need to review and consider that in future discussions. I understand that TEPCO is also of the same stance on this.

Next, with regard to my decision to return my annual salary as Prime Minister, as you have just pointed out, Ministers who are also members of the Diet receive salaries corresponding to their ministerial posts on top of their salaries as members of the Diet; this is the case for me as well, we do not receive two separate salaries. On my part, like other members of the Diet, I have already given up a portion of my salary in my position as a general member of the Diet. I would like to retain the rest of salary as a member of the Diet in the same way as other Diet members. However, I plan to give up all the additional allowances that I receive as Prime Minister, both the monthly allowances and bonuses.

As far as the other Cabinet ministers, I have not actually previously said anything in particular to them about this, and in any case, there is no doubt that the Prime Minister shoulders the heaviest responsibility under circumstances such as these. I have touched on this subject before while talking to Minister Kaieda, and I believe he will make a decision based on his own judgment. I have not spoken to any of the other Ministers about this particular topic.

CABINET PUBLIC RELATIONS SECRETARY: Letfs hear from the next person. Mizushima-san, please go ahead.

REPORTER: Prime Minister, thank you for taking my question. Regarding the approach to some of the key bills from the final portion of the Diet session, for example, a special measure was implemented to extend tax reductions, but I think this will expire before long. Furthermore, the establishment of a special bond bill to issue deficit-covering government bonds seems to no longer be on the horizon either. Will the current Diet session be extended in order to establish legislation like this? Or rather, do you think another option will be possible? Please tell us what you think.

PRIME MINISTER KAN: There is consensus on this issue among the Policy Research Council chairmen of the three parties, and so I hope to move forward with this in some way, at as early a stage as possible, based on a tripartite agreement.

However, at the current stage, we still do not know whether or not that will be possible. A range of consultations are underway on this, including with the Committee of the National Diet and the Secretary General of the Democratic Party of Japan (DPJ). At the present time, we are exerting every effort to make progress on this during the current Diet session.

CABINET PUBLIC RELATIONS SECRETARY: Next question please. Egawa-san, please go ahead.

REPORTER: I am freelance reporter, Egawa. Just now you used the words grecoveryh and greconstruction,h but looking at the situation at the nuclear power station and how it has affected those residing in the surrounding area, it doesnft seem like conditions are such that they can even begin such recovery or reconstruction efforts yet. Being unable to make decisions about what to do over even the coming months, these people are grappling with great instability in their lives. I have heard people say that TEPCOfs provisional payments of one million yen will be gone due to the loans payments. At the same time, those in temporary housing will have to pay living expenses by themselves, but they have no income. The Government has spoken of compensation, but we have no idea when this will be given. It is issues like this that the people are unanimously complaining about.

I would like to ask whether a decision will be made soon on a method to ensure month-to-month support for evacuees. I feel there are various possibilities for this, for example, it could take the form of advance compensation payments.

PRIME MINISTER KAN: As I said earlier, I recently visited Kazo City in Saitama Prefecture, where there are a fairly large number of people who have been displaced by the nuclear incident. A range of serious efforts are being made to support them, including by the Governor of Saitama Prefecture and the Mayor of Kazo City. Employment guidance and other types of assistance are available to them. For example, in the evacuation center, which used to be a high school, HelloWork service providers have set up workspaces in some of the corridors.

Whenever I talk to people in evacuation centers, the comment I hear most frequently is of course that they want to return home as soon as possible. But answering that is no easy task. They want to know what the prospect is of being able to go home, what they can do otherwise and when they can do it. I think that without knowing such information, even if an individual finds new employment or considers leaving their evacuation shelter and moving into one of the many public housing units available to them, it is difficult for them to decide what to do. This has been frequently pointed out to me.

In that sense, it has now been two months since the earthquake, and we need to see the establishment of some sort of light at the end of the tunnel. This might come in the form of progress by TEPCO on their roadmap or further work toward recovery. If an endpoint for the problem can be established - that is, once we are able to say that there will be absolutely no further release of radioactive materials and that a cold shutdown has been achieved - from then onward those in evacuation shelters will be able to establish their own future goals. This is something I have stated before.

Regarding the issues of livelihoods and work, the Government is expending every effort to help people lead dignified lives and establish prospects for the next step. I hope to continue to make the maximum possible efforts to this end.

CABINET PUBLIC RELATIONS SECRETARY: Next we would like to call on a member of the foreign press. The person with their hand up, please.

REPORTER: I am Yamaguchi of the Associated Press. There is a great deal of international interest in how Japan will bring the incident at Fukushima Daiichi Nuclear Power Station under control and how the incident will impact Japanfs energy policy going forward. The G8 Summit will be held in the near future and there are also other international meetings scheduled such as the Japan-China-ROK Trilateral Summit. Could you say something about how you intend to explain the situation surrounding the incident at Fukushima and the future outlook for Japanfs energy policy, including whether or not the Government intends to move away from a nuclear power-oriented policy, at these international meetings?

PRIME MINISTER KAN: As you rightly mention, the Japan-China-ROK Trilateral Summit will be held on May 21, and the G8 Summit will be held in France on May 26 and 27.

In addition, the schedule for the International Atomic Energy Agency (IAEA) International Ministerial Conference on Nuclear Safety has now been confirmed for June and Japan must also submit a report for that meeting.

Your question concerned the Governmentfs thoughts regarding energy policy towards the future, and firstly, with regard to nuclear power, I would say that we will implement a thorough investigation into the recent situation and diligently aim to identify ways in which nuclear power can be made safer. This is one of the major pillars of government policy that I will be explaining in international meetings.

In order to achieve this aim, Japan will naturally continue to make efforts and has to date provided the international community with various data relating to the details and content of the incident at the nuclear power station, and will make further efforts to provide this information. It is the wish of the Government that this information would be of use to the international community in ensuring a safer supply of nuclear energy in the future.

In addition, as I have mentioned earlier, many countries in Europe and North America are focusing efforts on wind and solar energy, in addition to nuclear power and fossil fuels. Japan is lagging somewhat behind in this field and we will make further efforts in this regard. It is these concepts and the stance of the Government that I would like to present to the international community.

CABINET PUBLIC RELATIONS SECRETARY: Next, Matsuyama-san, please.

REPORTER: I have a question regarding the request to halt operations at Hamaoka Nuclear Power Station. There have been criticisms made that the announcement was extremely sudden and that the government is seeking to restrain corporate activities without legal basis. Among these, Chairman of Nippon Keidanren, Mr. Hiromasa Yonekura, has been particularly vocal in his criticism, having stated that the decision came out of the blue and that the thought processes behind the decision were like a gblack box.h

Could you explain again why such a sudden announcement was made concerning this important decision, which could impact the future of Japanfs nuclear policy?

In addition, although Chubu Electric Power has indicated that it will accept the request to halt operations, it is requesting that the Government provide assistance to cover cost increases and other matters. Could you tell us if it is the Governmentfs intention to provide financial assistance to cover the cost increases that will be incurred by Chubu Electric Power?

PRIME MINISTER KAN: It has been previously pointed out that Hamaoka Nuclear Power Station lies on an active fault. However, it goes without saying that the recent events following the disaster of March 11 have had a significant and direct impact on the decision to issue the request, given the fact that prior to the disaster, it is said that Fukushima Daiichi Nuclear Power Station operated by TEPCO was disaster-proof, only for the cooling functions to be lost following the disaster, which led to this serious incident.

Given this situation, the Cabinet convened a number of meetings, including the Disaster Prevention Council, where discussions covered the possibility of earthquakes in various other locations and I confirmed once again the figure of 87%. This prompted questions about how to respond to this issue and I sought the opinions of various persons.

Minister of Economy, Trade and Industry Kaieda also received a number of views and opinions and in the final instance we exchanged these views and information, and after a process of careful deliberation we reached the conclusion that making such a request would be necessary in the interests of public safety and security.

REPORTER: What are your intentions with regard to the provision of financial assistance to Chubu Electric Power?

PRIME MINISTER KAN: That will be a matter for consultation from now, but speaking in general terms the Government will need to cooperate as much as possible. With regard to what specific form this cooperation will take and how cost increases will be handled will be a matter for future discussion.

CABINET PUBLIC RELATIONS SECRETARY: Since wefre running over our scheduled time, this will be the last question. Sakajiri-san, please.

REPORTER: I am Sakajiri of the Asahi Shimbun. Allow me to confirm something about the Nuclear Incident Investigation Commission which you touched on in your opening statement. As you also said in your response just now, although you had stated that inquiries must be made into the nuclear incident, the request to shut down the Hamaoka Nuclear Power Station was made even before the inquiries were made.

In that case, will the activities of the Nuclear Incident Investigation Commission be limited to identifying the cause of the incident at the Fukushima Daiichi Nuclear Power Station? Or depending on the findings, do you also foresee taking further steps, such as reviewing the future nuclear energy policy or making additional shutdown requests? May I ask which of these two it is?

PRIME MINISTER KAN: As I stated a moment ago, the Investigation Commission we are working to set up will be based on the principles of independence, transparency, and comprehensiveness. The committee shall thoroughly investigate not only the technical problems but also institutional problems and so forth as they relate to the underlying cause of the incident.

As to where we go from there, I believe once the Investigation Commission comes out with a report, discussions will need to be carried out in light of that. As of now, I do not foresee the Investigation Commission going so far as to issue any sort of conclusion or vision. At first, I believe the committeefs functions will be limited to carrying out a thorough investigation of the incident at TEPCOfs nuclear power stations in Fukushima and the underlying factors which led to it.

International Ideas Competition for Planning Helsinki South Harbour Opens.

South Harbour Competition Seeks Direction for Developing the Core of Helsinki

HELSINKI -- The Helsinki City Planning Department is organising the international South Harbour ideas competition as part of the World Design Capital Helsinki 2012 programme. The entrants' task is to create a comprehensive ideas plan for the South Harbour that can be used as a basis for the future development of the area.

The competition area is situated in a highly central location, covering the entire 23-hectare shore area of the Helsinki South Harbour. The area is an essential part of the city's identity. The urban profile of the South Harbour opening to the sea can be considered the visiting card of Helsinki. The historical centre of Helsinki is also located close to the shore.

The purpose of the competition is to integrate the area more tightly into the city structure. The idea is to provide city residents with access to the sea and the opportunity to experience and create urban culture. New uses are sought for the buildings. It is also possible to construct new buildings in the area. The passenger ports and traffic solutions are to be developed further, since passenger ship traffic will continue.

"Many waterfront projects are about enlivening harbour or industrial areas no longer in use. We are now planning the most valuable core of the capital - an area that is actively used by city residents and that hosts a busy cruise port. Today, a large part of the area is off limits to the public, and a lot of space is taken up by parking," says Tuomas Rajajarvi, head of the Helsinki City Planning Department, describing the challenges that the entrants are expected to solve creatively.

During the World Design Capital Helsinki year, the city seeks inspiring means by which residents can become involved in developing their living environment. As a basis for the competition, the City Planning Department surveyed the thoughts of nearly five hundred residents on the area and its future. The results of this survey are available to the entrants.

The competition is open to everyone, and entrants are encouraged to form design groups consisting of experts in a variety of fields. One of the jury members evaluating the entries is the American architect Steven Holl, who designed the Museum of Contemporary Art Kiasma in Helsinki.

The competition period is from 2 May to 30 September 2011. The competition entries will be made available for public viewing and commenting in the Internet and at the information and exhibition space Laituri in the autumn. The result will be resolved in the spring of 2012. A total of [euro]165,000 will be distributed as prizes.

SUMMERVILLE MAN GETS FOUR YEARS FOR CHILD PORN.

COLUMBIA, SC -- The following information was released by the Columbia Division of the Federal Bureau of Investigation:

Acting United States Attorney KEVIN F. MCDONALD stated today that KEVIN J. POWERS, age 47, of Summerville, South Carolina, was sentenced today in federal court in Charleston, for Possession of Child Pornography, a violation of Title 18, United States Code, Section 2252A(a)(5)(B). Senior United States District Judge P. Michael Duffy of Charleston sentenced Powers to four years imprisonment, followed by life-time supervised release.

Evidence presented at the guilty plea hearing established that Powers downloaded child pornography from the Internet using the Limewire file-sharing program. In March 2009, Powers' wife called the Dorchester County Sheriff's Office to report that she had found child pornography on his computer. After deputies arrived, Powers consented to the search of his computer and agreed to be interviewed. He confessed to downloading thousands of images of child pornography over the last five years. A forensic examination of Powers' computer found more than 100 videos of child pornography.

The case was investigated by agents of the Dorchester County Sheriff's Office and the FBI. Assistant United States Attorney Rhett DeHart of the Charleston office prosecuted the case.
